Literary Bound Designs Terms of Use
Welcome to Literary Bound Designs. By engaging our services and receiving any files or designs from us, you agree to the following terms and conditions. Please read them carefully, as they form a legally binding agreement between you ("the Client") and Literary Bound Designs ("the Designer"). If you do not agree to these terms in their entirety, you may not use or access the designs provided.
1. Ownership and Intellectual Property
All original artwork, designs, and concepts created by Literary Bound Designs remain the intellectual property of the Designer. This includes, but is not limited to, layout, image style, placement, and font selections.
The Client does not have the right to alter, reproduce, sublicense, or transfer the design to another party without explicit written consent from Literary Bound Designs.
Unauthorized use or modification of the designs will result in the immediate termination of the Client’s usage rights and may lead to legal action.
2. Usage Limits
Upon receipt of full payment, the Client is granted exclusive rights to use the cover design for up to 500,000 printed copies. E-book usage is limited to 500,000 copies as well.
If the Client anticipates exceeding these limits, they must notify Literary Bound Designs to arrange for any necessary additional licensing. The Client will be responsible for any additional fees associated with increased usage.
3. Modifications
The Client agrees that only Literary Bound Designs may modify or alter the design. Any alterations by another party, including the Client, are prohibited and will result in the forfeiture of the Client’s rights to use the design.
Should the Client require alterations after the final files have been delivered, additional charges may apply.
4. Stock Imagery
All stock images used in the designs are licensed for commercial purposes. Literary Bound Designs has secured the necessary rights for their use.
The Client is responsible for adhering to the usage limits of the stock images, typically limited to 250,000 printed copies and 500,000 e-books. If an extension is required, the Client will be responsible for additional licensing fees.
5. Attribution
Literary Bound Designs requires proper attribution in both the eBook and printed versions of the work. The attribution should read:

6. Confidentiality
All information shared by the Client is considered confidential and will not be disclosed to third parties without the Client’s consent, except as required by law.
Literary Bound Designs reserves the right to use the Client’s pen name, book title, and cover design for promotional purposes, including on our website, portfolio, and social media platforms.
7. Client Responsibility
It is the Client’s responsibility to ensure the accuracy of the design by ordering a proof copy from their printer before the book goes on sale. Literary Bound Designs is not liable for any errors or issues after the final files have been approved and sent.
The Client must provide exact book templates and size specifications for print and digital displays. Any changes required after final delivery due to incorrect specifications may incur additional charges.
8. Liability
Literary Bound Designs is not liable for any damages, including loss of revenues, profits, business, reputation, or data, arising from the use of our services.
The Client assumes full legal and financial responsibility for any intellectual property disputes arising from materials they provided to the Designer.
9. Termination
Either party may terminate this agreement at any time with written notice. Upon termination, the Client’s rights to use the design will cease immediately. Literary Bound Designs retains all intellectual property rights to the work created.
If the agreement is terminated by the Client, no refunds will be issued.
10. Dispute Resolution
Any disputes arising from these terms and conditions will be resolved through mediation or arbitration, in accordance with the laws of Quebec, Canada. Both parties agree to submit to the exclusive jurisdiction of the courts located in Quebec.
11. Code of Fair Practice
Literary Bound Designs affirms that all work created is original and has not been previously published, except where explicit consent has been obtained. The work does not contain any scandalous, libelous, or unlawful matter.
The Client agrees not to use Literary Bound Designs' products in any way that may infringe upon the rights of others.
12. Terms Acceptance
By receiving and using the designs provided by Literary Bound Designs, the Client agrees to all terms and conditions outlined in this document. Continued use of the designs constitutes acceptance of these terms.
